What is a Trial by Written Declaration (TR-205)?

In California, Vehicle Code Section 40902 allows you, the cited driver (defendant) to contest traffic tickets in writing, without appearing in court. A TR-205 (Trial by Written Declaration) is available in cases involving violations of the Vehicle Code or of local ordinances of the Vehicle Code. Eligible violations for a Trial by Written Declaration must be infractions only. Misdemeanors and cases involving accidents are not eligible for the option of a Trial by Written Declaration.


What is required of me (the defendant) to process a Trial by Written Declaration for fighting traffic tickets?

You will have to plead “not guilty” when requesting the Trial by Written Declaration.  Further, the court requires that, when using a Trial by Written Declaration, the bail (or the fine amount of your ticket) is paid up-front when we process your paperwork. This means that when you mail your documents to BustMyTrafficTicket.com’s parent company Ticket Busters of California (TicketBust.com), you must include a check payable to the Superior Court for your bail amount. If you have not received your courtesy notice from the court or do not know the bail amount, call the court to get the bail amount for your citation. You can still send all your documents to ticketbust.com to begin the process even if you do not know your bail.


When do I get results from the court on the progress of fighting my traffic ticket?

After we submit your completed Trial by Written Declaration to the court on your behalf, you will be notified by the court (not ticketbust.com) at your preferred address within 60-90 days after the date of submission to the court.
